There is actually no substantive difference between a healthcare power of attorney and a medical power of attorney. These terms are often used interchangeably to refer to the same legal document. The slight variation in terminology can sometimes cause confusion, but rest assured they serve the same essential purpose in estate planning and advance care directives.
Both a healthcare power of attorney and a medical power of attorney designate an individual (often called an agent or proxy) to make medical decisions on behalf of the person creating the document (the principal) if they become incapacitated or unable to make such decisions for themselves. This legal instrument grants the appointed agent the authority to consult with doctors, access medical records, and make critical healthcare choices in accordance with the principal’s wishes.
The choice of terminology often depends on regional preferences, individual attorney practices, or specific state laws. Some jurisdictions may favor one term over the other, but the underlying legal concept and function remain the same. It’s worth noting that in some cases, you may also encounter similar documents referred to as a “healthcare proxy” or “durable power of attorney for healthcare decisions.”
When creating or reviewing these documents, it’s crucial to focus on the content and powers granted rather than getting caught up in the specific title. Regardless of whether it’s called a healthcare power of attorney or a medical power of attorney, the document should clearly outline the agent’s authority, any limitations on that authority, and ideally, provide guidance on the principal’s healthcare preferences and end-of-life wishes.
