To revoke a power of attorney (POA), you should take several steps to ensure it is properly terminated:
First, review the original POA document carefully. Some POAs include specific instructions for revocation. If so, follow those procedures exactly. If not, you’ll need to create a written revocation statement.
Draft a clear revocation document that includes:
– Your full name and address
– The date of the original POA
– A statement that you are of sound mind and acting of your own free will
– Language explicitly revoking the POA
– The date of revocation
– Your signature
Sign the revocation in front of a notary public. Provide copies of the signed, notarized revocation to the agent named in the original POA and any institutions or individuals who may have relied on it (e.g. banks, doctors, etc.). Request written confirmation that they’ve received the revocation.
If the original POA was recorded with your county recorder’s office, you should record the revocation there as well. Destroy any copies of the old POA in your possession. Finally, if you still need someone to act on your behalf, create a new POA naming a different agent or with modified terms.
