Do you need a power of attorney form? We make a do-it-yourself power of attorney: finance power of attorney or healthcare power of attorney.

To revoke a financial power of attorney in California, you should take the following steps:

1. Create a written revocation document. This should clearly state that you are revoking the power of attorney, identify the original power of attorney document by date and title, and include the name of the agent whose authority you are terminating. Sign and date the revocation document in the presence of a notary public.

2. Notify your agent in writing that you have revoked their authority. Send them a copy of the signed and notarized revocation document via certified mail with return receipt requested. This creates a record that they were informed of the revocation.

3. Notify any third parties who may have been relying on the power of attorney, such as banks, investment firms, or healthcare providers. Send them a copy of the revocation document as well. This helps prevent the agent from continuing to act on your behalf with these institutions.

4. If the original power of attorney was recorded with the county recorder’s office, you should also record the revocation document with the same office. This creates a public record of the revocation.

5. Destroy any copies of the original power of attorney in your possession. Request that your former agent return or destroy any copies they have.

It’s important to note that if you created a new power of attorney naming a different agent, this does not automatically revoke the previous one unless it explicitly states so. To ensure there is no confusion, it’s best to formally revoke the old document using the steps above.
