No, you cannot validly sign a power of attorney over text message. Powers of attorney are important legal documents that require proper execution to be valid and enforceable. There are several reasons why a text message would not suffice:
First, powers of attorney generally need to be signed in writing by the principal (the person granting the power). A text message does not constitute a formal signature for legal purposes. Most states require an actual physical signature or, in some cases, a proper electronic signature that meets specific legal requirements.
Second, many states require that the signing of a power of attorney be witnessed and/or notarized. This provides an extra layer of authentication and helps prevent fraud or undue influence. Obviously, this witnessing or notarization cannot occur via text message.
Third, powers of attorney often need to meet certain formatting and content requirements to be valid. A text message is unlikely to include all the necessary language and provisions required for a legally binding power of attorney document.
