First, the person granting the power of attorney (known as the principal) should determine the specific powers they wish to grant and the duration of the temporary arrangement. It is crucial to be clear about the scope and limitations of the authority being given.

Next, the principal should obtain or draft a power of attorney document that complies with their state’s laws. Many states offer standardized forms, but it may be advisable to consult with an attorney to ensure the document meets all legal requirements and accurately reflects the principal’s intentions.

The document should clearly state that it is a temporary power of attorney and specify the exact start and end dates or triggering events for its effectiveness. It should also detail the powers being granted and any restrictions on those powers.

Once the document is prepared, the principal must sign it in the presence of a notary public. Some states may require additional witnesses. The person designated as the agent (also called the attorney-in-fact) should also sign the document, acknowledging their acceptance of the responsibilities.
